ABOUT BANKRUPTCY


​CHAPTER 7

Those individuals whose income is in line with the Chapter 7 income requirements and whose assets can be fully protected under bankruptcy law can file a Chapter 7 bankruptcy to eliminate their dischargeable debts.  These debts typically include credit card debt, medical bills and repossessions.  Other debts are also eligible to be discharged. Some may choose to pay for their house or car and keep them and others may choose to discharge these debts and surrender their home or car to the lender. About one month after the bankruptcy is filed the individual that filed will have to attend a hearing known as a Meeting of Creditors.  Then, 4-5 months after the Chapter 7 case is filed the Court will issue the discharge which means that the dischargeable debts have been eliminated and the case will be closed.

 

CHAPTER 13 

A Chapter 13 bankruptcy is used by individuals who require a payment plan to resolve their debt issues.  Maybe their income is too high to file under Chapter 7 and they have to pay back some or all of their debt, without interest, through a Chapter 13 payment plan.  Maybe they own too much valuable property which would mean that if they filed under Chapter 7 some of their property would be sold with the non-exempt proceeds used to pay their creditors. To avoid the sale of their property they could pay an amount equal to the non-exempt equity in their property to their creditors through a Chapter 13 payment plan. The creditors would receive the appropriate amount and the individual could keep his or her property.  A Chapter 13 payment plan can run for 36-60 months.  Others may need to use the 36-60 month Chapter 13 payment plan to stop a foreclosure and pay the arrears on their mortgage. About 1 month after the Chapter 13 case is filed the individual will have to attend a hearing known as a Meeting of Creditors.  Then, a few months after the Chapter 13 is filed the attorney will attend a Confirmation Hearing where the Court decides whether the Chapter 13 plan can be approved/confirmed. After the individual makes the last plan payment the Court will issue the discharge and close the case.

3. After you have paid the fee in full and supplied all of the necessary documents, Mr. Greenberg will prepare your bankruptcy petition and have you sign it so that it can be filed with the Bankruptcy Court. About one month later he will see you at your first bankruptcy hearing, the Meeting of Creditors.
